GENERAL TERMS AND CONDITIONS OF USE OF THE SITE
1. PREMISE
This document provides the General Terms and Conditions of Use of www.bancodelligiene.it website (hereinafter referred to as respectively the "General Terms" and the "Site") to be followed by anyone wishing to browse the Site.
Access to the Site and performance of any activity involving browsing its pages constitute full and unreserved acceptance of the General Terms. In the event that the user does not accept the General Terms, it is sufficient for him/her to stop browsing the web pages of the Site.
Anyone accessing the Site implicitly declares not to use the Site and the material herein contained for any purpose being unlawful or otherwise contrary to the applicable law.
The General Terms may be modified by Banco dell'Igiene Onlus at any time, without further notice to users, provided that it is left to the users to periodically read them before accessing the contents of the Site. Access to Site after the application of any modification implies the full and unreserved agreement to the General Terms as modified. Wherever in the pages of the Site products and services are offered or contents are presented, subject to special terms and conditions stated in these pages, these special terms and conditions shall prevail over the General Terms.
2. CONTENT OF THE SITE
Description
The official website of Banco dell’Igiene Onlus, www.bancodelligiene.it, is an online information and entertainment portal that provides updates on the main Banco dell’Igiene activities. The Site also offer an overview of Banco dell’Igiene Onlus’ main promotional and commercial activities, products and services, and modes of access.
All Content on the Site (news, photos, videos, trademarks, logos, domain names and so on) is protected by copyright and industrial property laws, and can only be used can only be used for personal information purposes, with the exclusion of any other use without previous written consent by Banco dell’Igiene Onlus.
Offer to the users
The Site may include hypertext links to websites of both third parts and companies belonging to the same group as Banco dell’Igiene. Hypertext links have the sole purpose of facilitating the user’s browsing experience without there being any relationship between the content of the Site and the third party site. Banco dell’Igiene also declares not to have any effect on the structure of the third party sites, nor guarantees the truthfulness, accuracy or adequacy of the materials or information there included. Whether the linked site has specific conditions of use, these will apply instead of the General Terms.
3. RIGHTS OF INTELLECTUAL AND INDUSTRIAL PROPERTY
All Content on the Site is protected by copyright and industrial property laws.
Any unauthorized removal or re-use of material on the Site is prohibited, in the same way as any other activity that could harm the legitimate interests of the authors or owners of the copyrighted works.
The Site and its Content can only be used for personal, educational or instructional purposes, with the exclusion of any direct or indirect commercial purpose. The details of the owner of the intellectual property rights must always be mentioned and left intact, and the Content may not be modified in any way.

At the same time, it is noted that all the trademarks, domain names, trade names, company names and signs on the Site are the sole property of Banco dell’Igiene Onlus, and are registered and protected by laws and regulations on distinctive marks. They may not be reproduced in any form without the express authorization of Banco dell’Igiene Onlus, and the “Banco dell’Igiene Onlus” mark may not be registered on any top level domain.
The pages of the Site may also contain marks, domain names, company names and signs owned by third parties with whom Banco dell’Igiene Onlus has dealings, who enjoy the same level of legal protection as that of the distinctive marks of Banco dell’Igiene Onlus.
Banco dell’Igiene Onlus notes that the use of distinctive marks such as metatags and html commands is strictly prohibited, as although they do not allow the display or formatting of a certain command, they provide instructions to online agents or search engines to boost the search results of sites other than those linked to Banco dell’Igiene Onlus.
4. CONDITIONS OF USE OF THE SITE
Banco dell’Igiene Onlus announces that the content of the Site may not be, in whole or in part, copied, reproduced, republished, uploaded, duplicated, transmitted or distributed in any way or form without the prior written consent of Banco dell’Igiene Onlus, except for activities of printing, downloading and viewing of the content of the Site made for your own personal and non-commercial use, provided that the material in question is not modified in any way and all the information related to intellectual property rights and / or industrial affixed therein are kept. Furthermore, the content of the Site may not be distributed, in whole or in part, through communication channels, i.e. Internet, video systems, radio or any other instrument without a prior written authorization by Banco dell’Igiene Onlus.
Also, the information and materials contained in the Site cannot be used for commercial purposes in order to create databases of any type and gender, nor be stored (in whole or in part) in previous databases, both accessible only by the creator and available to third parties.
5. LINKING AND FRAMING
Without prior written authorization by Banco dell’Igiene Onlus, it is strictly forbidden to create hypertext links to the home page of the Site currently accessible at www.bancodelligiene.it (hereinafter referred to as the "Home Page") or to any other internal page of the Site.
If there is an interest to create an hypertext link to the Home Page from a website, it is necessary to send a request by e-mail to info@bancodelligiene.it which must include: (a) data of the person responsible for the technical aspects of managing the site where the hypertext link to the Home Page is meant to be created (including e-mail and phone number); (b) the data of the applicant company; (c) an indication of the web site where the hypertext link will be created; (d) any additional information considered useful in order to obtain authorization from Banco dell’Igiene Onlus. Any specific link which redirects the user to an internal page without passing through the Home Page ("deep linking"), as well as automatic link ("inline linking") which allows the user to automatically view in a specific space images from the Site is expressly banned.
Framing links, which allow a website page to appear on a specific page of another site while the content of that page appears inside a frame instead of a separate browser window, are also prohibited.
The violation of this article will be subject to prosecution, also with regard to unfair competition, and is governed by the applicable laws.
6. DISCLAIMER
All of the content on the Site is provided for information purposes only. Banco dell’Igiene Onlus gives no warranty as to its accuracy or completeness, and reserves the right to amend and update the content without prior notice. Banco dell’Igiene Onlus will not be held liable for any direct or indirect loss or damage including loss of profits that may derive from the use or impossibility of using the Site and its content, or from the use of sites connected directly or indirectly to it, or from errors or omissions.
7. SEVERABILITY
If any provision of these Terms and Conditions of Use is considered illegal, null and void or ineffective for any reason, the invalid clause will be removed and shall not affect the validity or effect of the remaining clauses.
8. GOVERNING LAW AND FORUM
Without prejudice to any other rights available to users under the terms of national or supranational laws, the General Terms are subject to and shall be interpreted in accordance with the laws of Italy (with the exclusion of the rules of international private law), including any disputes concerning the existence, validity or effect of the General Terms and any other agreement they may refer to.
Without prejudice to what above stated, the Court of Milan shall have sole jurisdiction over any disputes arising in relation to these General Terms and any other agreement they may refer to.
In the event of any dispute as to the interpretation of the Italian and English versions of these Terms and Conditions of Use and of the Code of Conduct, the Italian version shall prevail.

PRIVACY - Information on the processing of personal data for marketing and promotional activities
The following Privacy Notice (hereinafter referred to as the "Notice") is provided pursuant to section. 13 of Legislative Decree. N. 196/2003 – Data protection code to those who interact with web services of Banco dell’Igiene Onlus accessible on www.bancodelligiene.it (hereinafter also referred to as the "Site" ).
The Notice only applies to the Site and not to third party sites which may be accessed through hypertext links.
1. Objectives of data handling
IN ACCORDANCE WITH SECTION. 13 OF LEGISLATIVE DECREE. N. 196/2003 – DATA PROTECTION CODE
The Personal Details voluntarily provided by Users to Banco dell’Igiene Onlus will be gathered and processed for the following purposes:
(a) contact the user who has sent a request, and to this end has provided their data in the proper section of the Site, for the presentation of products by Banco dell’Igiene Onlus and its sales and assistance network in the world and / or by entities collaborating in the business of Banco dell’Igiene Onlus and / or from parent, subsidiaries and / or associated companies of Banco dell’Igiene Onlus. This can be done by sending information or promotional communications, even of a commercial nature, advertising material and / or offers of performances and services, by mail, internet, phone, e-mail, MMS, SMS from Italy or abroad (including from Countries outside the European Community), (b) sending newsletter/s requested by the user, (c) preparation of studies and statistical and market researches.
2. Type of handled data
Browser data
The computer systems and software procedures used to operate the Site acquire, during their normal operation, some personal data whose transmission is implicit in the communication protocols of the Internet.
This information is not collected in order to be associated with identified entities, but by its very nature could, by means of processing and association with data held by third parties, allow identification of users.
This data includes IP addresses or domain names of computers used by users who connect to the Site, the URI (Uniform Resource Identifier) of requested resources, time of request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of response from the server (successful, error, etc.) and other parameters regarding the operating system and the user’s computer environment.
This data is only used to obtain anonymous statistical information on the use of the Site and to check that it is functioning correctly. It is deleted immediately after processing. The data may be used to investigate liability for computer crimes against the Site: except in these circumstances, web contact data is not currently kept for more than seven days.
Data voluntarily provided by users
The optional, explicit and voluntary sending of e-mail messages to the addresses listed on the Site involves the acquisition of the sender's address, necessary to respond to requests, and any other personal data included in the communication.
Specific summary notices will be posted or displayed in the pages of the site designated for special services on request.
3. Information on the use of cookies
The user is informed that the Site uses cookies and similar technologies. Cookies are information that could be stored by your browser on your hard disk in order to record the navigation paths on the site. The consequence is that every time the User returns to visit the Site, he/she will be identified together with the preferences made on previous accesses.
These files allow the customization of a Web site, to provide the user with easier navigation and, through a numeric control of the various web pages accesses, a better presentation of the more requested information. The cookies only pick up anonymous information and, therefore, do not allow the processing of data relating to the user. In any case, in addition to the aforementioned navigational data, no other personal information will be collected, with the obvious exception of those who will be voluntarily provided by the user.
The treatment of your personal details will be handled by using suitable electronic devices and/or printed copies, strictly related to the above mentioned purposes and, in any case, so as to ensure the security and confidentiality of data.
4. Provision of data and consequence of refusal
The User is under no obligation to provide personal information, however any missing or inaccurate details may make it impossible for Banco dell’Igiene Onlus to contact the user for the presentation of products or sending newsletters, information or promotional communications, even of a commercial nature, advertising material and/or offers of performances and services or for the participation of the user in the preparation of studies and statistical and market researches.
5. Communication of data
The user's personal data collected by Banco dell’Igiene Onlus will be communicated to the sales and service network of Banco dell’Igiene Onlus in the world as well as to entities collaborating in the business of Banco dell’Igiene Onlus and / or to parent, subsidiaries and / or associated companies of Banco dell’Igiene Onlus, for the purposes set out in paragraph 1.
Inside Banco dell’Igiene Onlus, the user’s personal data may be accessed by any legal representative of Banco dell’Igiene Onlus, employees, with particular reference to employees who are involved in the development of products marketed online, customer care, marketing activities, maintenance of electronic instruments and, anyway, the Data Manager and Data Processors in charge of the processing of personal data.
Personal data may also be communicated to any qualified entity who provide to Banco dell’Igiene Onlus with performances or services for the purposes above set out in paragraph 1, herein including individuals and companies who manage and/or participate in the management and/or maintenance of the Site and the electronic equipment.
In pursuit of the activities set out in paragraph 1, Banco dell’Igiene Onlus will be able to benefit from the following categories of entities who may be aware of your personal details: qualified entities, such as banks, firms and insurance companies, suppliers and subcontractors, who provide Banco dell’Igiene Onlus with instrumental services for the sending of newsletters, information or promotional communications, even of a commercial nature, the development of statistical and market researches, the organization and conduct of events and shows, also of a promotional nature; to legal, tax, insurance, accountancy, organizational; any other person whom the information should be disclosed in accordance with an express provision of law.
Personal data may be transferred abroad, in compliance with the current regulations including in Countries outside the EU, where Banco dell’Igiene Onlus pursues its interests.
6. Disclosure of data
User’s personal data will not be disclosed nor communicated to third parties but the ones indicated herein.
7. Rights of the user
In relation to the purposes set out in paragraph 1, the User may exercise the rights under Art. 7 of Legislative Decree June 30, 2003, n. 196, which, for convenience, are transcribed below.
Art. 7 - Right of access to personal data and other rights
1. You have the right to obtain confirmation of the existence of personal data concerning yourself, even if not yet registered, and their communication in intelligible form.
2. You have the right to be informed about: a) the origin of personal data; b) the purposes and methods of treatment; c) the logic applied in case of treatment with the help of electronic means; d) the identity of the owner, manager and the representative appointed under article 5, paragraph 2; e) subjects or categories of entities to whom the data may be communicated or who can learn about them as appointed representative in the State, managers or agents.
3. You have the right to obtain: a) updating, rectification or, when interested, integration of data; b) the cancellation, anonymization or blocking of data unlawfully processed, including data that do not need to be kept for the purposes for which they were collected or subsequently processed; c) confirmation that the operations in letters a) and b) have been notified, also as regards their content, to whom the data were communicated or disclosed, unless this requirement impossible or involving the use of means clearly disproportionate to the protected right.
4. You have the right to object, in whole or in part: a) for legitimate reasons to the processing of their personal data, even if it is pertinent to the aim of the data collection; b) to the processing of their personal data with the purpose of sending advertising materials or direct sales or for carrying out market researches or commercial communication.
8. Information about advertising activities
Participation in marketing activities is voluntary and in accordance with art. 7, paragraph 4, letter. b) and Article. 130 of the Code concerning the protection of personal data, in particular as regards electronic communications via email, telefax, messages such as MMS (Multimedia Messaging Service) or SMS (Short Message Service).
